Technically, it wasn't an illegal action. You can try and use the move, but you still cooldown. It's done all the time.

Actually, just got confirmation it's illegal to NOT use a move during an expected cooldown. Ordering cooldown means there's a chance you're needlessly not using a move. Therefore, it's legal and what happened is final.

In ASB, Fake Out's flinch is based on the target. Since Budew didn't switch, Fake Out can't flinch it again.
