if two people use the same dark horse, you cant win. Only condition is if you use a different one with it.

Yep.
Lack of discussion won't guarantee you can't win it just really improves your odds. In regards to ladder ranking it hasn't been terribly high as of late because nobody's been submitting. Going 15-0 has been enough to win.
