Pain split is a move blocked by sub and taunt. And it doesn't do direct damage. It just changes HP. If you want more proof, its category is "Other", not "Special" nor "Physical". That's just shoddy having a bug.

Its well known than in the battle frontier the AI cheats, all the more in EMERALD. The AI must have some kind of system predicting what the outcome will be, and so decide using that attack or not.
