This statement is incorrect. According to CardsoftheHeart's damage calculator, 58.91% - 69.80% is only dealt when not factoring the sandstorm boost. When taking the sandstorm into account, Latias will deal 39.11% - 46.53% to max HP Tyranitar.
I believe that Latias will not be allowed because she is actually still a suspect. Nothing deemed a suspect will lose that status until after stage 3 of the test, and therefore Latias cannot be allowed in a metagame which is "suspect-less" besides for Latios.
