I just had a brainwave. The reason why this issue hasn't been raised in Japan might be because Giratina, Shaymin and Rotom are Banned Pokemon in Pokemon Tournaments, and the Japanese tend to play by these rules on Wi-Fi, hence why nothing has been heard about it.

If you have a japanese game, It will connect to the japanese servers. Same for every region.
