You don't need action replay. You just put it in and send it over the GTS to recieve it.

Legal hacks refers to programs like PokeSav and PokeGen where you can create any pokemon with any stat, move set, evs, etc. and get them on your ds. It's considered hacking but as long as you have legal movesets, evs, abilities, etc. then it's considered legal.
