Done Mimic vs Substitute in Gen 3

What type of bug are you reporting? Mechanics

What is the bug?
Mimic fails while opponent is behind sub, despite the hover info for Mimic in the move selection area claiming that it bypasses substitute.

Gen 3 OU Ninetales vs Claydol
Turn 76 opponent (behind sub) used Cosmic Power.
Turn 77 I used Mimic but it failed.
Turn 76

Ninether used Flamethrower!
The substitute took damage for the opposing Claydol!

The opposing Claydol used Cosmic Power!
The opposing Claydol's Defense rose!
The opposing Claydol's Sp. Def rose!

Ninether restored a little HP using its Leftovers!
The opposing Claydol restored a little HP using its Leftovers!

Turn 77

Ninether used Mimic!
But it failed!

Are you able to replicate it? If so, how?
happened again, now i'm not even going for it in games since i'm pretty sure it will keep failing until this is fixed or if the tooltip is actually wrong
this time it was the 1st use of mimic in the game, so i don't it was failing because it thought mimic was already supposed to have a copied effect.
both times it also was while i was imprisoning the foe, though i can replicate it without having imprison active
