If this is the case, then you keep Snorlax. If your opponent fights you without their Pokemon, and still tries to claim a Pokemon, then tell them to fuck off. Meowiekins, that will be your first and last warning. Next time, I'll disqualify you from Conquest.

EDIT: If this is the case, then CoolStoryBrobat you will not have Snorlax. Sorry mate.

To clarify, since I've gotten a lot of questions about this, once you have more than your two Pokemon, you can use whatever combination of them as you'd like. For example, Omfuga doesn't need to use Cloyster if he doesn't want to at this stage in the game.
