SiCK R3 Its_A_Random vs. SOLID GOLD

Okay lodging an official protest based on that the above is bending the rules and basically giving solid a third chance while everyone only gets two chances because of his constant tottering on DQ and shit.

By definition of SiC(K) battle rule #3:
Strict 3-day Disqualification. You will get a single warning per round. After that, you go over DQ and you're done. Referees please tag the combatants when you have finished your reffing. Players, if you know you're going to be away you better post a Leave of Absence BEFORE you leave, or give a very good reason in case of an emergency.
1) Okay so the time limit is 3 days which is analogous to 72 hours. I last posted 16th November, 2014 at 9:17 AM (GMT+11:00) and called it 19th November, 2014 at 9:23 AM (GMT+11:00). This is the equivalent of 72 hours, 6 minutes, 6 minutes past DQ. S0L1D G0LD posted one minute after I called it.
2) Definition of strict means not relaxed, which implies that going over DQ to the minute is grounds for a warning for a DQ, validating 1).
3) "You will get a single warning per round." This was legally given on October 29th, 2014 (GMT+11:00) while the last post was October 26th, 2014 (GMT+11:00) by the referee with S0L1D G0LD due to order. Of course xenforo is dumb with dates but at the time the times were shown to the minute, S0L1D G0LD was roughly eight hours over DQ.
4) "After that, you go over DQ and you're done." This implies that people have two chances. By 3), that first warning used up S0L1D G0LD's first chance and by 1), S0L1D G0LD was over DQ when I called it.
5) "Referees please tag the combatants when you have finished your reffing." Mulan15262 did do this, which makes both 1) and 3) valid.
6) "Players, if you know you're going to be away you better post a Leave of Absence BEFORE you leave, or give a very good reason in case of an emergency." This page spans LoA's between October 9th, 2014 and November 19th, 2014 (GMT+11:00). There is no post by S0L1D G0LD on this page. Furthermore, "I'd like to dedicate this "fuck you" to my clock, for being off by ~1hr and tricking me into thinking I had more time." is not a valid reason for going over, because user S0L1D G0LD does not deny that he was not busy and had no excuse to not post on time bar an incorrect clock that was easily avoidable and by 1) there was clearly a gap of over 72 hours between posts.

Therefore, by the SiCK rules with regards to Player DQ and and the above statements, it is logical to conclude that I believe I am entitled to a win by DQ. also anecdotal but i did not see solid in the users viewing thread thing when I went to call it. sure he might have had it open in a tab but we cannot prove either

Of course if that gets rejected, I will take it as long as it is justified and will need to order, so...

IF
ShadowStrike + Giga Impact is deemed infeasible, AND Cursed Body disables Mega Alakazam's Shadow Ball A2, THEN use Phantom Force A3.
IF ShadowStrike + Giga Impact is deemed infeasible, THEN use Metal Burst A3.

Mulan15262 hold off on refereeing until the protest is resolved please. :)

The DQ period - in other words, how much time does each person (both players and ref) have to post what they need to before they can be disqualified from the battle? The standard amount is 3 days. Note that this is a minimum and, if your opponent or ref doesn't post in this period for any reason, it is common courtesy to send them a reminder and give them one or two more days to post, unless they are consistently late. If a player is disqualified, the battle ends. If the ref is "disqualified", a post must be made in the Battle Tower containing a link to the battle and a request for a subref so the battle can continue.
This implies that when DQ is called, that is it iirc. Also points 1 to 6 are there to objectively prove the disqualification is valid haha.
 
Not questioning whether you couldn't call for DQ (so points 1 to 6 are moot aka not the question at hand). But it is common for people to just carry on if orders were given before the referee saw the thread. It happened many many times in the past, so I won't bother searching for examples.

BUT I admit that you have a good case here and that just letting it go will make it seem that the strict DQ isn't that strict. So yeah you have a point somewhat. Also it is a custom and not 100% of the refs do that. Depends on the ref and the opposing battler.

When in doubt, say it is ref discretion and be freed from the problem! haha. So uh Mulan15262 , your call. You can carry on and overlook the DQ or call it. Either decision has solid grounds and is final and I shouldn't have butt in oops. After that we can discuss what should we do from a policy point of view. But this is not the adequate place for that.

Ehhh while there is precedent for that thing, there is a ruling in the handbook (quoted in an edit to my previous post) which by implication, contradicts that precedent. Basically if DQ is called, that is pretty much it. This has pretty much been the implied ruling since the start of ASB iirc. The super outdated Battle Tower backs this up and those are pretty much the only concrete sources on DQ (by implication).

I am okay with referee decision however, whatever it is. I can understand why you would not want to rule on this and yeah. I am basically going by the book here and doing what I feel is the right thing to do that is in my rights as a battler.

My honest reason for gong over dq is that I was posting at the same time as air, but I just pressed the "post" button too slow. I really don't care, and I know this doesn't change anything at all, but I'm not going to let this be remembered as me being too fucking dumb to post on time. I thought I did, but obviously it turned wrong.

I guess I should explain myself. I do not want to be branded as a princess or someone who is a complete asshole for this whole saga, but I want people to understand where I am coming from and all.

Basically DQ is a tough subject for many people. Some people might think that DQ is "cheap" while others do not. I am sure some people think I did the right thing while others think that I should have courteously waited but yeah. We are all players. We all play this game whether it is competitively or casually. As someone who generally plays competitively I will take serious matches like Tournaments and Gym Matches seriously and as a result, I will generally play to win. If I am playing to win as I would in serious matches, then I should do anything that is in my power (i.e. in the book) to try and achieve that goal. If that means taking a hard line stance on strict DQ, then so be it as long as it is legal to do such (which is generally the case). It does not mean I will always be like that. If my opponent and I agreed to something longer or we are playing a tower match or it is a tournament final (see tournament guidelines) or my opponent has declared that they are on a LoA (whether gone for some time or being slow), then I will definitely respect that and be more lenient as long as it does not take a stupid amount of time. Otherwise I will enforce it because 1) it is within the rules to be tough on it and 2) I like many others do not want a tournament to run forever and we get enough problems as it is with regards to that.

As for why I protested, it is pretty obvious. Because of the way ASB rules and SiC(K) rules are on player DQ, it was logical to push for it because I had a case for it and argued it, backing it up. At the same time I understand why Frosty did not want to rule on it since I have been there myself so I share his pain. The handling of this whole thing could have been a bit better but I feel we were all mature about it to some degree and yeah.

If the same thing happened again in the future with me involved then I would definitely do it again because like everyone else who wants to win the tournament, I play to win and if it means calling DQ when the conditions are met, then so be it. I understand if this whole saga may have put a bad taste in people's mouths but it is time in my opinion that people started taking DQ seriously for tournaments like this so they do not drag out and all.

While I do feel bad for solid given the position he is in, he could have easily avoided this whole situation by not leaving things to the last minute (especially against someone like me) and I hope this whole experience improves him as a battler and in his time management skills since I feel he has the potential to go far in ASB. It was certainly a good game we had and I was certainly on the ropes there (even though I made a bad mistake R1 that put me on the back foot for the rest of the match) and if you were better with your time, you definitely had the potential to take out this match and possibly the tournament.
