The maker of the Pokemon admitted to doing so already. But if you are really interested, most of the Pokemon with that OT that passed Legal.exe have wrong Ability type. Meaning while the Pokemon may have had a PID that would have resulted in Ability 0, the Pokemon had an Ability 1 instead. It's just plain bad hacking :P
No, all of them are hacked. The maker of the Pokemon is apparently altering the PID of the Pokemon to make them seem legit. Don't rely on Legal.exe (I believe that's what you're doing).
Quick note, the Wish (ID 07898) Pokemon that you have (or had) on your thread are indeed hacks.
